Illustrative statutory cap under Article 99 of the AI Act

Under Article 99 of the AI Act, transparency-related infringements are subject to a statutory maximum of €15 million or 3% of global annual turnover — whichever is higher. For SMEs and start-ups, Article 99(6) instead caps this at whichever of the two amounts is lower.

The slider below is purely an illustration of that statutory cap. It is not a prediction of an actual fine. Real sanctions depend on the circumstances, cooperation, severity, duration and the competent national authority.

Important context

  • Article 50 obligations are not universal — provider and deployer responsibilities depend on the system, role, branding, control and contract.
  • SME status can lower the cap; the exact formula is verified against the current official text before we surface a separate SME calculation.
  • This page is guidance and not legal advice. Final responsibility remains with your organisation.
